Terms of service

These Terms of Service (“Terms”) govern access to and use of gorseli.com, hydragoldskin.com, and other websites, content, features, and services operated by Battle Born Global LLC through the GORSELI brand (collectively, the “Services”). “GORSELI,” “we,” “us,” and “our” refer to Battle Born Global LLC.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy, Refund Policy, Shipping Policy, and any terms shown with a specific offer are incorporated into these Terms.

1. Eligibility

You must be at least 18 years old or the age of legal majority where you live and able to enter a binding agreement to use the Services or place an order. If you use the Services for an organization, you represent that you have authority to bind that organization.

2. Accounts and information

If account features are available, you must provide accurate, current information and protect your credentials. You are responsible for activity under your account and must notify hi@gorseli.com promptly if you suspect unauthorized access. You may not impersonate another person or use another person’s information without authorization.

3. Product information and cosmetic-use notice

We work to present product descriptions, images, ingredients, colors, sizes, counts, prices, availability, and other information accurately. Device displays and production variations can affect appearance. We may correct errors and update information at any time, subject to applicable law.

GORSELI products are cosmetic products unless expressly stated otherwise. Website content is provided for general cosmetic-product education and is not medical advice, diagnosis, or treatment. Results vary. Read and follow the final product label and instructions. Stop use if irritation or another unexpected reaction occurs, and seek medical care when appropriate.

4. Orders and acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may accept, reject, limit, or cancel an order for reasons including suspected fraud, unauthorized resale, pricing or inventory error, payment failure, shipping restriction, or inability to fulfill. If we cancel after payment, we will issue an appropriate refund.

Products are offered for personal or household use unless we authorize otherwise in writing. We may limit quantities by person, household, account, payment method, or address.

5. Prices, taxes, and payment

Prices are shown in U.S. dollars unless stated otherwise and may change without notice before an order is placed. Taxes, shipping, and other charges are displayed at or before checkout when applicable. You authorize us and our payment providers to charge the selected payment method for the total shown. You represent that you are authorized to use the payment method and that the billing information is accurate.

6. Shipping, delivery, and title

Shipping and delivery are governed by our Shipping Policy and the information displayed at checkout. Delivery dates are estimates unless expressly stated as guaranteed. Risk of loss and title pass as provided by applicable law. Nothing in these Terms limits rights that cannot lawfully be limited.

7. Cancellations, returns, and refunds

Contact hi@gorseli.com as soon as possible to request an order change or cancellation. We cannot guarantee changes after processing begins. Returns, refunds, and exchanges are governed by our Refund Policy. If we cannot ship within a promised time, we will provide any delay, cancellation, and refund options required by law.

8. Promotions and offer terms

Promotions, discounts, gift cards, giveaways, waitlists, subscriptions, or other offers may have additional terms disclosed with the offer. Unless stated otherwise, promotions cannot be combined, have no cash value, and may be modified or ended before an order is placed, subject to applicable law. A waitlist or early-access signup is not a preorder and does not guarantee inventory, price, launch timing, or the opportunity to purchase.

9. Intellectual property

The Services and their content, including the GORSELI and HydraGold names, logos, product presentation, text, graphics, photographs, videos, designs, software, and arrangement, are owned by or licensed to us and are protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for personal, noncommercial purposes in accordance with these Terms.

You may not copy, reproduce, modify, distribute, sell, license, scrape, frame, reverse engineer, remove notices from, or create derivative works from the Services except as permitted by law or with our written permission. No license to any trademark is granted by implication.

10. Reviews, submissions, and user content

If you submit a review, photograph, video, comment, idea, feedback, or other content (“User Content”), you represent that it is truthful, based on genuine experience where applicable, does not violate law or another person’s rights, and that you have the rights and permissions needed to submit it. Disclose any incentive or material relationship. Do not submit private, confidential, defamatory, misleading, infringing, unlawful, or harmful content.

You retain ownership of your User Content. By submitting it for public display or promotional use, you grant GORSELI a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and use it for operating, improving, and promoting the Services, subject to applicable law and any separate permission terms. We may moderate or remove content using content-neutral rules for spam, abuse, privacy, illegality, or irrelevance, but we do not promise to review every submission.

11. Prohibited conduct

You may not:

Use the Services for an unlawful, fraudulent, abusive, or deceptive purpose.

Interfere with the security, operation, or integrity of the Services, including through malware, automated attacks, scraping that burdens the Services, or attempts to gain unauthorized access.

Use false identity, payment, order, or delivery information.

Infringe intellectual-property, privacy, publicity, or other rights.

Use the Services or content to compete unfairly with GORSELI, create counterfeit products, or misrepresent an affiliation with us.

Circumvent quantity limits, access controls, or other operational restrictions.

12. Third-party services and links

The Services may use or link to third-party services, including Shopify, payment providers, carriers, social networks, and other websites. We do not control third-party services and are not responsible for their content, availability, or practices. Your use of them may be governed by separate terms and policies.

13. Electronic communications

You consent to receive transactional communications electronically, including order, account, policy, and service notices. Marketing communications require the consent applicable to the channel and can be stopped as described in the message or our Privacy Policy.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT WILL ALWAYS BE COMPLETE OR CURRENT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED. THESE TERMS DO NOT LIMIT ANY NON-WAIVABLE CONSUMER WARRANTY OR OTHER STATUTORY RIGHT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BATTLE BORN GLOBAL LLC, GORSELI, AND THEIR OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THOSE PARTIES FOR A CLAIM ARISING FROM OR RELATED TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. FOR A CLAIM NOT RELATED TO A PURCHASE, TOTAL LIABILITY WILL NOT EXCEED 100 U.S. DOLLARS.

THE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY TO THE EXTENT A LIMITATION IS PROHIBITED.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Battle Born Global LLC, GORSELI, and their owners, officers, employees, agents, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights. This section does not require indemnification for our own unlawful conduct.

17. Suspension and termination

We may suspend or terminate access to the Services if we reasonably believe you violated these Terms, created risk or legal exposure, or used the Services unlawfully. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, indemnification, and dispute provisions.

18. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where the law of your residence requires otherwise. Subject to non-waivable consumer rights, disputes must be brought in a state or federal court with lawful jurisdiction in North Carolina, and the parties consent to that jurisdiction and venue.

19. Changes to the Services or Terms

We may update the Services and these Terms. We will post revised Terms and update the effective date. Changes apply prospectively unless law permits otherwise. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.

20. General terms

If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a business transaction or by operation of law. These Terms and incorporated policies are the entire agreement concerning the Services, except for specific written terms that apply to an offer or transaction.
